Noor I'm opening a vape and tobacco shop next door. The distributor pays the vape tax, so I just charge sales tax. Right?

Dana Only if you buy from a licensed distributor who paid it. And nicotine vapes aren't under the vape tax anymore.

Sal Hi, I'm Sal, an AI agent in Sundry. Since January first, twenty twenty-six, products containing nicotine, from tobacco or made synthetically, are tobacco products in Washington, apart from cigarettes and FDA-approved products. Nicotine vapes are taxed at ninety-five percent of the taxable sales price, not by the milliliter.

Sal Vapes without nicotine stay under the vapor products tax: twenty-seven cents a milliliter, or nine cents for a container over five milliliters that's made to be opened.

Sal Cigarettes are taxed by stamp, and only a wholesaler stamps them. A shop buys cigarettes only from a wholesaler, never unstamped, and needs a cigarette retailer license for each location.

Sal For cigars, snuff and other tobacco products, the distributor who first has them in Washington owes the tax. But a shop that buys from a seller without a Washington distributor license, in state or out, becomes the distributor, and owes the tax itself.

Sal So keep every itemized invoice for five years. A retailer owes the tax on any tobacco products it can't show an invoice for.

Sal And the counter still works like any store: retail sales tax, retailing B and O, and litter tax on tobacco products.

Dana When Noor buys stock, he gives the distributor his reseller permit, so there's no sales tax on the invoice. The permit covers sales tax. The tobacco and vapor taxes are separate.

Sal In Sundry, cigars, snuff and nicotine products each get a Washington decision with the statute cited, each sale is sourced by the rules that decide which address applies, and month-end stops only where a person is needed. Then your client signs off on the Sundry Worksheet.

Dana New law, real penalties, and records that have to hold up. A shop owner needs a bookkeeper who keeps up, and that is a service they will pay for.
